A great place to start is with posters needed under federal law. These posters are required by agencies such as the Department of Labor (DOL) or Equal Employment Opportunity Commission (EEOC):
• Employee Rights Under the Fair Labor Standards Act — Required if you have 1 or more employees
• Employee Rights Under the Employee Polygraph Protection Act (EPPA) — Required if you have 1 or more employees
• Job Safety and Health: It’s the Law! (Occupational Safety and Health Act, OSHA) — Required if you have 1 or more employees
• Equal Employment Opportunity (EEO) is the Law — Required if you have 15 or more employees
• Employee Rights Under the Family and Medical Leave Act (FMLA) — Required if you have 50 or more employees
• Uniformed Services Employment and Reemployment Rights Act (USERRA) — Required if you have 1 or more employees; This could be emailed to employees rather than posted
From there, things get a little more complicated. Some posters only apply in certain situations. For example:
• E-Verify. Employers participating in the E-Verify program need to download and display the E-Verify and Right-to-Work posters
• Employee Rights Under the H-2A Program. This needs to be posted by agricultural employers with workers who have H-2A visas.
• Workers with Disabilities Paid at Special Minimum Wages: This is required for employers with workers employed under special minimum wage certificates
If you have a contract subcontract with the federal government to provide a service or do a construction project, you have additional posting requirements. All federal contractors need to post the Employee Rights Under the National Labor Relations Act posting. In addition, they need to display other postings required in their contract.
Finally, you will also have posting obligations under state or local laws. These posters might relate to minimum wage, paid leave, unemployment insurance, or anti-discrimination laws. Your state department of labor website is a good place to begin when looking for these required postings. You can also check the website of your state’s human rights commission.
